Kitchen and Bathroom Gallery products are warranted to be free of defects in material and workmanship for one year from date of delivery.
During the limited warranty period, Kitchen and Bathroom Gallery will repair or replace any defective parts within a reasonable time. A refund may be issued if a replacement is no longer available. The decision to repair, replace or refund will be made solely by Kitchen and Bathroom Gallery.
Kitchen and Bathroom Gallery’s maximum limit of liability under the limited warranty shall be the actual cash value of the product at the time the consumer returns the product for repair, which determined by the price paid by the consumer for the product less a reasonable amount of usage.
The consumer shall bear the cost of sending the product to Kitchen and Bathroom Gallery. Kitchen and Bathroom Gallery shall bear the standard shipping cost of sending the product back to the consumer after the completion of service under this limited warranty.
Many products are made of natural stone, wood or metals. Because of the natural variations, and/or handmade nature of the product, slight differences and imperfections are expected and are not considered manufacturing defects.
Stone components may have imperfections such as veins, pits and pores. These are natural blemishes and imperfections which are inherent to stone. The imperfections not resulting in structural failure are not covered under this warranty.
Parts and service which are not covered by this limited warranty are your responsibility.
Conditions & Limitations
- Notice of failure or defect must be reported to us in writing within a reasonable time
- This warranty does not cover normal wear and tear or cosmetic damages, including but not limited to scratched finish. We have the sole discretion to decide what constitutes a manufacturer's defect and what constitutes normal wear and tear
- This warranty only applies to products serviced in the US
- This warranty is not transferable and is extended only to the original purchaser of a new product which was not sold “as-is”. A purchase receipt or other proof of the original purchase date is required for warranty service.
- The warranty ALSO DOES NOT COVER damages which occurred in shipment, or failures which are caused by products not supplied by Kitchen and Bathroom Gallery, or failures which result from accidents, misuse, abuse, neglect, mishandling, misapplication, alteration, faulty installation, set-up adjustments, improper storage, improper maintenance, modification, or commercial use (such as in a hotel, office, restaurant, or other business), rental use of the product, or damage that is attributable to acts of God.
- In no event shall Kitchen and Bathroom Gallery be liable for any other costs related thereto, including but not limited to loss or damage to personal property resulting from the use of product, or for any lost time, labor cost or inconvenience that may caused. Expenses related to removing the product from an installation are not covered under this limited warranty. The consumer will be responsible for any expenses related to reinstallation of the product.
- If the product is returned during the limited warranty period, but the problem with the product is not covered under the terms and conditions of this limited warranty, the consumer will be notified and given an estimate of the charges and the consumer must pay to have the product repaired with all shipping charges billed to the consumer. If the estimate is refused, the product will be returned freight collect. If the product is returned after the expiration of the limited warranty period, Kitchen and Bathroom Gallery’s normal service policies shall apply and the consumer will be responsible for all shipping charges.
IMPLIED WARRANTIES INCLUDING THAT OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. KITCHEN AND BATHROOM GALLERY DISCLAIMS ANY LIABILITY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
Some states/provinces do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of special, incidental or consequential damages, so these limitations and exclusions may not apply to you. This warranty gives you specific legal rights. You may also have other rights which vary from state/province to state/province. | | |
